Question: Am I SOL, or should I contact a lawyer?
I was in an accident. The guy who hit me, took blame (as he should… it was his fault) and offered to fix my car. Thing is, it was at a dealership, and he was a employee. The manager shortly after he gave me something in writing stating he would “paint and touch up” my car.

The damage to my car requires more than just paint and touch up. Essentially I need a new front bumper. I asked the manager for their insurance information several times, and he refused every time. He also started threatening me with “this is private property, and because of that, you are the only one at fault”. I called the cops. The officer came, and the manager tried to get the cop to not write a report (reason being, the car he hit me with, was just sold brand new, and with a filed report, they can’t just pretend it never happened, and they take a huge cut from the sales price). I refused, and asked for a police report.

While the police officer was filing the report, one of the officer staff went into my car without my permission and tried to steal that piece of paper that the man who hit me (employee of the dealership) gave me stating he would fix my car. The officer took care of that. While the officer was talking to the man who hit me, the manager sneaked up to me, and started threatening me again, this time stating “we are going to sue you, it’s your fault, this is private property”.

Note, that at this point, they had started lying, and changed their story to, I hit him. The officer didn’t tolerate that, told the manager if he tried to talk to me again, he was going to charge him with “intimidation” or some sort of “threatening” crime.

The officer, as is clear with the sheer physics involved in the accident, stated that the dealerships employee is at fault. He put in the report, that the dealership employee offered to fix my car. In addition to that, the dealerships employee had a revoked drivers licenses (ironic right?) and he was given a ticket for that.

I took my car to a repair shop, and called the dealerships insurance agency. Somebody came out and did a estimate.

They sent me a copy of the estimate. That was 4 weeks ago. Now the insurance claim adjuster refuses to pay, stating, he won’t pay until he speaks with the dealerships employee. Problem is, the dealership’s “risk management” department won’t give the guy who hit me the calls.

My car is not drivable, but the claims adjuster won’t give me a rental car voucher for more than 3 days. I don’t see any end in sight, with respect to when the dealerships employee will take a call.

I don’t know much about the law, but if a wife can sue her husbands mistress for 9 million dollars, there has to be something available to me, so that I can get my car fixed right? Is turning it over to my insurance the only option? Any advice?
